Gordon Copland concentrates his practice in complex litigation and health care matters. He routinely represents clients before the Health Care Authority (HCA) and other state regulatory boards on certificate of need, licensure and related health care matters. He has extensive litigation experience in antitrust litigation and in intellectual property litigation, including patents and trademarks.

Represented clients before HCA for:

  • Certificate of need matters ranging from determinations of reviewability through applications for major projects, e.g., major renovations, open heart programs
  • Health care acquisitions

Antitrust
As a member of the ABA's Antitrust Section from West Virginia, Mr. Copland concentrates his antitrust practice on:

  • Acquisitions
  • Staff privileges
  • Tying
  • Exclusive dealing
  • Boycott questions

In addition to litigating exclusive contract and staff privileges cases, he has provided advice on acquisitions, mergers and probable competitor/government reactions to proposed business relationships. Further, Mr. Copland has successfully represented Fortune 500 companies in antitrust litigation, including actions brought by the State.

Intellectual Property
Mr. Copland’s representation of intellectual property litigation includes both patent and trademark matters. Mr. Copland is a member of the Bar of the United States Court of Appeals for the Federal Circuit, and he has successfully argued patent cases before that Court.

PROFESSIONAL ASSOCIATIONS

Mr. Copland is a member of the American Bar Association and serves on the Antitrust and Health Care Committees. He is also a member of the National Health Lawyers Association. He served on the West Virginia Health Care Task Force's "Certificate of Need Panel" which was responsible for drawing up the draft State Health Plan for 1992. He is the co-author of two published articles in the West Virginia Law Review: "Government and Antitrust Enforcement in the Health Care Market: The Regulators Need an Update" and "Advance Medical Directives in West Virginia, Part Two." Mr. Copland has been admitted to the West Virginia Bar and the bars of the United States Supreme Court, the Court of Appeals for the Fourth Circuit, the Court of Appeals for the Federal Circuit, and various federal district courts.  Mr. Copland is also recognized in The Best Lawyers in America in the fields of antitrust law and health care law.

EDUCATION

Mr. Copland received his legal education from the Marshall-Wythe School of Law and received his undergraduate degree from Washington & Lee, graduating cum laude.
