John Callcott represents clients regarding an array of employment and commercial matters.  He also serves in a counseling capacity to employers, corporate officers and directors regarding day-to-day operating decisions and fiduciary duties.
    
AREAS OF CONCENTRATION

Labor and Employment Litigation and Counseling
Mr. Callcott counsels and represents clients regarding the following:

  • Representation of employers in employment litigation, including age, race, sex harassment and disability lawsuits.
  • Representation of employers in Deliberate Intent and other work place safety lawsuits.  Mr.  Callcott has significant experience regarding these matters as they pertain to the coal industry and other highly regulated environments.
  • Representation of management in labor arbitration proceedings.
  • Representation of employers and other fiduciaries in ERISA related benefits litigation.
  • Counseling regarding employment and discharge matters as well as privacy compliance issues.

Commercial Litigation and Counseling
Mr. Callcott counsels and represents clients regarding the following:

  • Breach of contract claims.
  • Breach of fiduciary duty and claims of bad faith as between shareholders, officers and directors.
  • Counseling regarding contract negotiation, formation and other operational issues.

Tort Litigation
Mr. Callcott has significant past experience in tort related matters, having represented both individual and corporate interests in a wide array of tort cases, including wrongful death lawsuits.

SPEAKING AND WRITING

Mr. Callcott is a frequent speaker and author on employment and litigation related topics, with an emphasis on technology issues.   He also serves as the chairperson of the firm’s Electronic Discovery Committee.

EDUCATION

Mr. Callcott received his law degree from Vanderbilt University and his undergraduate degree from Indiana University.  He has also been awarded the designation of Certified Information Privacy Professional by the International Association of Privacy Professionals.
