Paul Konstanty focuses his practice in the area of litigation. He represents clients in the areas of personal injury defense, commercial transportation, long term care/nursing home litigation, insurance defense and construction law. He is also involved in general representation of institutions of higher education.

REPRESENTATIVE EXPERIENCE

• Defended national trucking company in litigation where driver lost control of tractor and trailer, causing it to partially over-ride a passenger vehicle. Both passengers alleged brain injuries and presented significant life care plans at trial. Punitive damages were claimed for driver’s conduct and for allegations of prior bad acts against national trucking company.
• Defended a Fortune 500 company in mass tort litigation involving hundreds of product liability cases filed by heavy equipment operators who alleged that manufacturers produced and sold equipment that emitted noise in excess of permissible decibels. All plaintiffs claimed occupational hearing loss in litigation that spanned over seven years. All cases were consolidated by mass tort panel and were presided over by Honorable Booker T. Stephens, McDowell County Circuit Court, West Virginia.
• Represented an international pharmaceutical manufacturer in a $25 million dollar suit against a nationally-known design-build wastewater treatment firm in a complex design and construction defects case in state court. Also involved as parties were the defendant’s engineering consulting firms and sub-contractors.
