Toxic Tort Alert: BPA in Plastic Drinking Bottles and Baby Products

“Bisphenol A” (also known as “BPA”) is a component of clear polycarbonate plastic used to make plastic clear and shatterproof. Lawsuits, including class actions, have been filed in California, Connecticut and Missouri based upon alleged exposure to BPA via the use of plastic drinking bottles, baby bottle liners, pacifiers and other products.

BPA has received attention at the national level. On April 29, 2008, legislation was introduced in the United States Senate by way of S. 2928 to ban BPA from children’s products. The proposed Act is entitled the “BPA-Free Kids Act of 2008” and would ban the use of BPA from any product designed for or intended to be used by a child 7 years of age or younger. Under the legislation, BPA would be considered a banned hazardous substance under the Federal Hazardous Substances Act (15 U.S.C. 1261 et seq.)

Further, the National Toxicology Program within the National Institute of Environmental Health Sciences under the U.S. Department of Health and Human Services drafted the “NTP Brief on Bisphenol A” that had a peer review date of June 11, 2008. The brief describes some possible concern for neural and behavioral effects in fetuses, infants and children but also states that more research is needed in order to better understand the possible effects of BPA on humans.

Due to the high use of BPA in the United States, research, litigation, and legislation may continue.
